The LEATHER & LGBTQ Cultural District (LCD) recognizes that privacy is an important issue, so we operate in a manner consistent with the protection of your privacy. We developed this Privacy Policy pursuant to applicable law regarding the collection and use of Personally Identifying Information (“PII”) (defined below). This Privacy Policy outlines the types of information collected, how we use that information, as well as some of the steps we take to safeguard it. This Privacy Policy is also designed to inform you about how you may access, amend, or delete PII collected and how you may limit LCD’ use of your PII. We urge you to read this Privacy Policy in its entirety and hope it will help you make an informed decision about sharing your PII with us. On occasion, the Website is connected by “hyperlinks” to other companies’ websites; please note that LCD is not responsible in any way for the privacy practices of other websites and suggests that you review the privacy policies of those other companies’ websites before using them.

You do not have to share any personal information to use the LCD website, and we do not collect personally identifiable information without your permission. We do at times link to other websites, and LCD cannot control and is not responsible for the content or the privacy policies of those sites.

III.   The kind of personally identifiable information we collect

LCD collects the following types of personal information at our website:

How we use the information you provide when you become a member of LCD or participate in an online program, i.e. The Golden Dildeaux Awards

We gather contact information when you contribute to LCD online or via mail or when you join at a public event. We use this information to send you mail and email communications about LCD events, campaigns and publications and about local LCD activities and renewing your membership.

LCD also uses information gathered via the LCD website to improve our web-based services. LCD periodically performs statistical analyses of aggregate user behavior and characteristics in order to measure interest in and use of various areas on our website and to use such information to improve on our website’s ability to serve you better.

Cookies: LCD uses “cookies” on some web pages. A cookie is a small piece of data stored on an End User’s hard drive but does not itself contain any personal information. Cookies enhance an End User’s experience by saving the End User from having to verify they are an adult when moving from page to page on the website. An End User can choose whether or not they want to use the cookie.

IV.   How you receive emails from LCD

You will only receive emails from us if you have a) provided your email address when signing up for membership or b) you have signed up to receive LCD’s newsletters online, through a mailing or brochure, at an event or through some other venue or c) you requested follow up from a feedback form or d) you voted in the Golden Dildeaux Awards.

None of the information you provide via our website (including your email address) is shared with other organizations or parties.

In order to provide you with better and more relevant information, we compile information about email response and website usage. This information helps us to better understand our members’ site usage patterns and also what types of content and information may help improve your user experience on the LCD website.

All emails sent contain a link to unsubscribe.

V.   How you can access or correct your information

You can access and correct all your personally identifiable information that we collect online. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections. You can also correct and/or change any information regarding your membership by contacting our District Manager at manager@sflcd.org or by calling 415-237-3237.

VI.   How we protect your personal and financial information

LCD is extremely protective of the information gathered through its membership and websites. Our websites have security measures in place to protect against the loss, misuse or alteration of the information under our control.

When you contribute to LCD online, we use a secure server and encryption to protect your financial and other personal information during transmission. Although we take security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data, LCD does not guarantee that unauthorized third parties will never defeat measures taken to prevent improper use of your information.

Unfortunately, neither LCD’s network nor data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your information, LCD cannot ensure or warrant the security of member information. Thus, any information transmitted to us is done so at the your own risk. Once we receive Registrant information, we undertake substantial efforts to protect the confidentiality of this information consistent with this Privacy Policy.

VIII.   Children’s Privacy

Protecting the privacy of children is extremely important to us. The Website is intended for users who are 18 years old or older. We do not knowingly collect personally identifiable information from children under the age of 18. If we become aware that we have inadvertently received personally identifiable information from a child under the age of 18, we will delete such information from our records. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personally identifiable information without parental consent. If you have reason to believe that a child under the age of 18 has provided personally identifiable information, please contact us, and we will take appropriate action.

You may print and download portions of material from the different areas of the Website solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. You agree that you shall have no recourse against LCD for any alleged or actual infringement or misappropriation of any proprietary right in your communications to the Website.

X.   Indemnification

You agree to indemnify, defend and hold harmless LCD, its affiliates, officers, directors, employees, agents, licensors, vendors and any third party information providers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Website.

XI.  Miscellaneous

This Privacy Policy and the terms and conditions contained herein shall all be governed and construed in accordance with the laws of California and The United States of America applicable to agreements made and to be performed in California and The United States of America. You agree that any legal action or proceeding between LCD and you for any purpose concerning this Privacy Policy shall be brought exclusively in a federal or state court of competent jurisdiction sitting in California. Any cause of action or claim you may have with respect to the Website must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. LCD’s failure to insist upon or enforce strict performance of any provision of these terms and conditions in this Privacy Policy shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Privacy Policy. LCD may assign its rights and duties under this Privacy Policy to any party at any time without notice to you.
